User Account Regulations

The "User Account" Service described in the following Terms & Conditions is provided by Openweb s.c., a civil partnership fully responsible for the entire event. Detailed information about the partnership and its members can be found in our Privacy Policy.

Before setting up a User Account, carefully read the following Terms & Conditions.

By setting up an Account, the User by accepting the box with the information: "I accept the Terms & Conditions of the CMS Conf User Account", confirms that he has read the content and agrees to all its provisions.

§1 Definitions

Terms & Conditions
These terms & conditions, specifying the rules for creating and using a User Account on the CMS Conf website and using the Services, as well as the obligations of the Service Provider.
CMS Conf Website
Website and other tools, internet applications made available by the Service Provider via the Internet, owned by Openweb s.c. and available at the cmsconf.com domain address and/or at another address within the subdomain.
Administrator/Service Provider
An entity providing the User's Account and at the same time the Controller, i.e., Openweb s.c., a civil partnership. Detailed information about the partnership and its members can be found in our Privacy Policy.
User Account
A set of Services and functionalities available to the User after registration and logging in to the CMS Conf website and a set of User's data and settings related to the operation of Services requiring logging in.
E-mail address
Electronic mailbox address through which the User can send and receive messages regarding, among others, operation of the website and Services provided as part of the CMS Conf website. The e-mail address acts as a login and together with the password is used to log in to the CMS Conf website and its Services.
User
A natural person including acting as a representative of a legal person who effectively activates the User's Account and actively uses the available functionalities.
User Profile
A collection of data, information and other elements presenting and describing the User, provided voluntarily and independently by the User in the process of setting up a User Account or while using it, with the proviso that some data may be necessary to be completed if the User wishes to use other Services offered by the Administrator.
User Profile Database
A collection of data, information and other content contained in Profiles. These data are collected and processed with the User's consent by the Administrator in an orderly manner in the IT system.
Contract
An agreement to provide Services electronically by the Administrator to the User.
Services
Services provided electronically by Administrator based on Act on electronic provision of services of 18 July 2002, by the Administrator, specified in these Terms & Conditions ensuring the possibility to use other services offered by the Administrator, described in separate regulations.

Terms referring to the processing of personal data, unless otherwise indicated in the Terms & Conditions, have the meaning described in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

§2 General Provisions

These Terms & Conditions define the rules for creating and using a User Account on the CMS Conf website and using the Services provided electronically.

The Administrator provides the User Account service free of charge, unless otherwise specified in separate regulations for specific Services.

The Administrator reserves the right to modify, suspend, or discontinue the User Account service or any part thereof at any time, with or without notice, for any reason.

The User Account service is provided "as is" and "as available" without warranties of any kind, either express or implied.

§3 Registration and Account Creation

To create a User Account, the User must:

  • Be at least 18 years of age, or if under 18, have the consent of a legal guardian
  • Provide accurate, current, and complete information during registration
  • Provide a valid email address
  • Create a secure password
  • Accept these Terms & Conditions
  • Accept the User Account Information Clause

The User is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

The User must immediately notify the Administrator of any unauthorized use of their account or any other breach of security.

§4 User Obligations

The User is obliged to:

  • Use the User Account in accordance with applicable law, these Terms & Conditions, and good practices
  • Provide accurate, current, and complete information
  • Update their information promptly if it changes
  • Not share their account credentials with third parties
  • Not use the User Account for illegal purposes or in a way that may harm the Administrator or other users
  • Not attempt to gain unauthorized access to other accounts or systems
  • Not interfere with or disrupt the operation of the website or Services
  • Respect the intellectual property rights of the Administrator and third parties
  • Comply with the Code of Conduct when using the Services

§5 Administrator's Rights and Obligations

The Administrator has the right to:

  • Modify, suspend, or terminate the User Account service at any time
  • Refuse to provide or continue providing services to any User who violates these Terms & Conditions
  • Remove or modify any content posted by Users that violates these Terms & Conditions or applicable law
  • Monitor the use of the User Account to ensure compliance with these Terms & Conditions
  • Take legal action against Users who violate these Terms & Conditions or applicable law

The Administrator is obliged to:

  • Provide the User Account service in accordance with these Terms & Conditions
  • Protect User's personal data in accordance with applicable data protection laws
  • Inform Users about significant changes to the Terms & Conditions
  • Respond to User inquiries in a timely manner

§6 Personal Data Protection

The processing of personal data in connection with the User Account is governed by the User Account Information Clause and the Privacy Policy.

By creating a User Account, the User consents to the processing of their personal data in accordance with the User Account Information Clause and the Privacy Policy.

§7 Account Termination

The User may terminate their User Account at any time by:

  • Using the account deletion function in the account settings, or
  • Sending a request to delete the account to hello@cmsconf.com

The Administrator may terminate or suspend a User Account immediately, without prior notice, if:

  • The User violates these Terms & Conditions
  • The User violates applicable law
  • The User engages in fraudulent, abusive, or illegal activity
  • The User Account is inactive for an extended period (as determined by the Administrator)
  • Required by law or court order

Upon termination, the User's right to use the User Account and Services will immediately cease. The Administrator may delete the User's account and all associated data, subject to applicable data retention requirements.

§8 Intellectual Property

All content, features, and functionality of the CMS Conf website and User Account service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the property of the Administrator or its content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The User may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the website without the prior written consent of the Administrator.

§9 Limitation of Liability

The Administrator shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or other intangible losses
  • Damages resulting from the User's use or inability to use the User Account service
  • Damages resulting from unauthorized access to or alteration of the User's data
  • Damages resulting from third-party conduct or content
  • Technical failures, interruptions, or errors in the service

The Administrator's total liability for any claims arising from or related to the User Account service shall not exceed the amount paid by the User for the service (if any) in the twelve months preceding the claim.

Nothing in these Terms & Conditions is intended to limit or exclude any liability that cannot be limited or excluded by applicable law.

§10 Complaints and Disputes

Users may submit complaints regarding the User Account service by sending an email to hello@cmsconf.com.

The Administrator will review and respond to complaints within 14 business days of receipt.

Any disputes arising from or related to these Terms & Conditions or the User Account service shall be resolved in accordance with Polish law, and the competent court shall be the court having jurisdiction over the Administrator's registered office.

Users have the right to use out-of-court methods of resolving disputes, including mediation and the European Online Dispute Resolution Platform available at https://ec.europa.eu/consumers/odr/.

§11 Final Provisions

The Administrator reserves the right to amend these Terms & Conditions. Users will be notified of any planned changes in advance, in a manner that allows them to familiarize themselves with the new wording of the Terms & Conditions.

If the User does not accept the changes, they should stop using the Account and inform the Administrator by sending a message to: hello@cmsconf.com. Continued use of the Account after the date of entry into force of the changes constitutes acceptance of the new Terms & Conditions.

The Administrator reserves the right to amend the Terms & Conditions for important reasons, including:

  • The need to adapt the Terms & Conditions to legal provisions that have a direct impact on the Terms & Conditions and the provision of services by the Administrator
  • The need to adapt the Terms & Conditions to recommendations, orders, rulings, decisions, interpretations, guidelines, or decisions of competent public authorities
  • Expansion or change of the functionality of the User Account, including the introduction of new services provided electronically
  • A change in the technical conditions for the provision of services electronically
  • The need to remove ambiguities, errors, or typographical errors
  • Changes to contact details, names, identification numbers, e-mail addresses, or links included in the Terms & Conditions
  • Counteracting abuse, in particular in the area of cybercrime
  • Improving user service
  • Change in the process of concluding the Agreement using the User Account

Users will be notified of changes to the Terms & Conditions via e.g., a message sent to the email address provided in the User Profile, a message in the user panel, an announcement on the website, at least 14 days prior to the planned effective date of the changes.

If the User does not accept the amendments to the Terms & Conditions, they have the right to terminate the service agreement with immediate effect, no later than on the day of entry into force of the amended Terms & Conditions. The notice of termination of the Agreement should be submitted electronically to the e-mail address: hello@cmsconf.com.

Failure to terminate the agreement within the specified period shall constitute acceptance of the amended Terms & Conditions and their application to the continued provision of services.

The amendments to the Terms & Conditions shall enter into force on the date specified in the information, after the expiry of the notice period for termination of the Account service.

Unless otherwise specified in these Terms & Conditions or the terms and conditions of specific Services, the Administrator will communicate with the User via email. The User ensures that the email address provided in the User Account is regularly checked for messages received from the Administrator.
